Company correspondence as evidence in litigation, part 2 – When is it possible to safely use such correspondence?

The employee will not expose himself to adverse legal consequences of having and using company correspondence in a dispute with the employer if:

  • this was correspondence addressed to the employee;
  • the employee came into the possession of the correspondence legally;
  • the company correspondence sent to the employee’s private e-mail account did not contain information that can be defined as a trade secret;
  • the objective of transferring company correspondence to the employee’s private e-mail account was not to use the information contained in it in the employee’s business activities or the employee’s start of employment for an entity that is competitive with the employer;
  • the company correspondence was not transferred to a third party.
